Law Creation

 

 

Other then anarchy, no legal system can function without laws.  Thus, someone must create the laws.  How this is done and by whom must be answered in any form of government.

 

Throughout time, various systems have been used to create law, whether it be a monarch, legislature, or democracy.  Many of the free nations of the world today have settled on a form of representative democracy.  Where groups of individuals (typically groups are formed through geographical boundaries) choose representatives who then gather to create laws.  This form of government is championed by those who feel that ordinary people do not have the time to devote to educating themselves on every issue on which laws are created.  Thus, a representative is chosen who will then devote themselves exclusively to ponder and study on the proposed laws.  However, the power of the internet, and specifically the wiki model, has shown in recent times that all minds acting together can often come up with better ideas than any smaller group could.  Thus, if laws could be created by all then it would do away with the necessity of having a specific group set aside to create law.

 

If law creation was left to all (in the form of a wiki) then those interested and with expertise would likely gravitate to decision making in their specific field.  Additionally, as individuals took part in a small portion of the act of law creation (or at least had the opportunity to) they would have more trust in the laws that were finally created than they may have in similar laws created behind closed doors.  The monies and influence of the interest groups that dominate many governments today would be spent on trying to convince the masses that their cause is just and not a specified group of decision makers.

 

It would be helpful to show the current law of the country, with revisions as made by the users, and the reasons behind these revisions. We should not discard the work of politcians through out the ages, but instead seek to improve on it and make corrections where needed. It is also much harder to come up with laws from scratch then to refine existing ones. So what is needed, is a complete listing of all current laws perhaps based on http://www.statutelaw.gov.uk/ (for UK). However, the laws in thier current form seem convoluted and inaccessible and so a fresh start does look appealing.
